The individual named below (referred to as "I" or "me") desires to participate in roller skating and all related activities (the "Activity") at events organized and/or hosted by the Clintonville Roller Club, a community roller skating organization based in Columbus, Ohio (the "Club"), at various venues throughout Columbus, Ohio and surrounding areas. In consideration of being permitted by the Club to participate in the Activity and in recognition of the Club's reliance hereon, I agree to all the terms and conditions set forth in this instrument (this "Release").
Term of Agreement
This Release applies to all participation in Club activities for a period of one (1) year from the date signed.
Definition of Activity
For purposes of this Release, "Activity" includes, without limitation: roller skating; use of skating surfaces and surrounding areas; participation in lessons, instruction, or informal guidance; use of equipment (whether provided by me, the Club, or others); entry to and exit from event premises; time spent in common areas; and all related activities before, during, and after events, including setup and teardown.
Assumption of Risk
I AM AWARE AND UNDERSTAND THAT THE ACTIVITY IS A POTENTIALLY DANGEROUS ACTIVITY AND INVOLVES THE RISK OF SERIOUS INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE CLUB, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS. NOTWITHSTANDING THESE RISKS, I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE CLUB OR OTHERWISE.
Release and Waiver of Claims
I hereby expressly waive and release any and all claims, now known or hereafter known, against the Club, and its officers, directors, managers, employees, agents, affiliates, members, volunteers, successors, and assigns (collectively, "Releasees"), arising out of or attributable to my participation in the Activity, whether arising out of the ordinary negligence of the Club or any Releasee or otherwise. I covenant not to make or bring any such claim against the Club or any other Releasee, and forever release and discharge the Club and all other Releasees from liability under such claims.
Indemnification
I agree to defend, indemnify, and hold harmless the Releasees from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to my participation in the Activity, including but not limited to any claims brought by third parties as a result of my actions, omissions, or conduct during the Activity.
Medical Consent
I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activity. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. I hereby release and hold harmless the Club from any claim based on such treatment or other medical services.
Minor Participants
If the participant is under 18 years of age, a parent or legal guardian must sign below. The undersigned parent/guardian acknowledges and agrees that: (1) they have the legal authority to consent to the minor's participation; (2) they understand and accept the risks described in this Release on behalf of the minor; and (3) to the fullest extent permitted by law, they agree to release and hold harmless the Releasees from any claims arising out of the minor's participation in the Activity.
Severability and Governing Law
This Release constitutes the sole and entire agreement between the Club and me with respect to the subject matter contained herein and supersedes all prior understandings. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Release shall be governed by and construed in accordance with the laws of the State of Ohio. Any claim arising out of this Release shall be brought exclusively in the state or federal courts located in Franklin County, Ohio, and I consent to the jurisdiction of such courts.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK CAREFULLY AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND I SIGN IT FREELY AND VOLUNTARILY.
